Terms of Service

These Terms of Service ("Terms") govern your access to and use of Aigent Alert's AI phone answering and lead-notification service (the "Service"), provided by Aigent Alert ("we," "us," "our") to business clients ("Client," "you"). By using the Service, you agree to these Terms.

1. The service

Aigent Alert answers incoming phone calls on behalf of a Client business, collects information from callers (such as name, phone number, address, and reason for calling), and delivers that information to the Client via SMS and/or email notification. Aigent Alert may also transfer certain calls to a live phone number designated by the Client, including calls identified as emergencies.

2. Eligibility

You must be an authorized representative of the business you are registering, with the authority to enter into these Terms on that business's behalf and to route that business's phone calls through the Service.

4. No advice given to callers

The Service is designed to collect caller information only. It does not provide medical, legal, safety, or technical advice to callers, and Clients should not rely on it to do so.

5. Emergency transfers

Where configured, the Service may attempt to identify emergency calls and transfer them to a live number provided by the Client. This feature is provided on a best-effort basis. Aigent Alert does not guarantee detection of every emergency call and is not a substitute for direct emergency services (such as calling 911).

6. Fees and billing

Fees for the Service are set out separately at the time a Client signs up, and may be billed on a recurring or usage basis. Client is responsible for all fees associated with their account. Changes to pricing will be communicated in advance.

7. Data and privacy

Our collection and use of information through the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Service availability

We aim to provide reliable, continuous service, but do not guarantee uninterrupted availability. Scheduled maintenance, third-party outages (including telephony and messaging providers), or other factors may occasionally affect availability.

9. Termination

Either party may terminate use of the Service at any time. Upon termination, we will stop routing calls and notifications for the Client's account, subject to any outstanding fees owed.

10. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Aigent Alert will not be liable for indirect, incidental, special, or consequential damages arising from use of the Service, including lost business or lost leads, even if advised of the possibility of such damages.

12. Changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
